Abolishing Section 497 - Green signal to adultery???

Recently India was ATTACKED by none other than supreme court .. Yes There were few judgments like abolishing article 377, 497 and opening the doors of temple to all females…. OMG!!!… few felt like glorious Indian culture breathed its last!! No problem… each one has the right to have opinions. But when I spoke to my student Sushmitha Viswanathan currently a law student, I was surprised at the way the media interprets the news!! First let us see what does Section 497 in The Indian Penal Code says.. Adultery. —Whoever has sexual intercourse with a person who is and whom he knows or has reason to believe to be the wife of another man, without the consent or connivance of that man, such sexual intercourse not amounting to the offence of rape, is guilty of the offence of adultery, and shall be punished with imprisonment of either description for a term which may extend to five years, or with fine, or with both. In such case the wife shall not be punishable as an abettor. So women are not prosecuted for adultery, only men are. It doesn’t punish women because It treats woman as property of husband . If husband’s possession is used by some random person without his permission, that person shall be punished . i.e. a person having intercourse with someone else’s wife without that person’s consent , will be sent to jail because he has used another man’s property without asking him. But if he takes permission then it is not crime of adultery. So consent of husband is most important here. [ see second line] . However if wife has not consented then it is called as rape. Also it gives permission to the husband to have intercourse with any unmarried woman or a widow. Because adultery is held only against married woman . This law is silent about unmarried woman or a widow, because they are not anyone’s property . women become just possessions when they get married!! So we need a better law which treats men and women alike, punishes them alike or does not punish them alike. But court never said women can happily engage in to multiple relationships .There are other sections to handle the issues which arise due to adultery ….Only this section is invalid now. ಕೆಲ ದಿನಗಳ ಹಿಂದೆ ನಮ್ಮ ದೇಶದಲ್ಲಿ ಆಗಬಾರದ್ದು ಆಗಿ ಹೋಯ್ತು..... “ಸಂಸ್ಕೃತಿ, ವೈವಿಧ್ಯತೆ ಮಣ್ಣುಪಾಲಾಯ್ತು.. ವ್ಯಭಿಚಾರ-ಸಲಿಂಗಕಾಮಕ್ಕೆ ರಾಜಮರ್ಯಾದೆಯ ಸ್ವಾಗತ ಸಿಕ್ತು..ಅದೂ ಯಾರಿಂದ ?? ಸುಪ್ರೀಂ ಕೋರ್ಟ್ ನಿಂದ!!” ಅಂತ ಎಲ್ಲೆಲ್ಲೂ ತಲ್ಲಣ ಸೃಷ್ಟಿಯಾದ್ದು ನಿಮಗಿನ್ನೂ ನೆನಪಿರಬಹುದು ಅಲ್ವೇ....ಪತ್ರಿಕೆಗಳಲ್ಲಿ ಓದಿದಾಗ Section 497 ವಿಚಾರದಲ್ಲಿ ನಂಗೂ ಒಂದು ಕ್ಷಣ ಇದೇನಪ್ಪ ಹೀಗೆ.. ಅಂತ ಅನಿಸಿದಾಗ ಈಗ ಕಾನೂನು ಓದುತ್ತಿರುವ ನನ್ನ ಹಳೆ ಸ್ಟೂಡೆಂಟ್ ಸುಶ್ಮಿತಾಗೆ ಫೋನಾಯಿಸಿದೆ.. ಓ.. ಹೀಗಾ ಇದು ಅಂತ ಸತ್ಯ ಗೊತ್ತಾದ ಅನಿಸಿದ್ದು ಮಾಧ್ಯಮಗಳು ಇಂಥ ಸೂಕ್ಷ್ಮ ವಿಚಾರಗಳನ್ನು ಪ್ರಕಟಿಸುವಾಗ ಸ್ವಲ್ಪ ಹುಷಾರಾಗಿ ಪದಗಳನ್ನು ಬಳಸಬೇಕು. ಜನರ ಗಮನ ಸೆಳೀಬೇಕು ಅಂತ ಸತ್ಯದ ಸಮಾಧಿ ಮೇಲೆ ಸುಳ್ಳಿನ ಅರಮನೆ ಕಟ್ಟೋದನ್ನ ನಿಲ್ಲಿಸಬೇಕು... Section 497 ವ್ಯಭಿಚಾರದ ವ್ಯಾಖ್ಯಾನವನ್ನು ಈ ರೀತಿ ಕೊಡುತ್ತದೆ. “ ಒಬ್ಬ ಹೆಂಗಸು ಇನ್ನೊಬ್ಬನ ಪತ್ನಿ ಎಂದು ತಿಳಿದಿದ್ದರೂ, ಆಕೆಯ ಪತಿಯ ಒಪ್ಪಿಗೆ ಇಲ್ಲದೆ , ಆಕೆಯ ಜೊತೆ ಲೈಂಗಿಕ ಸಂಬಂಧವನ್ನು ಒಬ್ಬ ಗಂಡಸು ಹೊಂದಿದ್ದರೆ ಮತ್ತು ಇದಕ್ಕೆ ಆಕೆಯ ಒಪ್ಪಿಗೆ ಇದ್ದರೆ ಅದನ್ನು ವ್ಯಭಿಚಾರ ಎಂದು ಪರಿಗಣಿಸಲಾಗುವುದು. ಲೈಂಗಿಕ ಸಂಬಂಧವನ್ನು ಹೊಂದಿದ ಗಂಡಸಿಗೆ ಐದು ವರ್ಷಗಳ ಜೈಲು ಶಿಕ್ಷೆ ಮತ್ತು ದಂಡ ವಿಧಿಸಲಾಗುವುದು. ಆದರೆ ಲೈಂಗಿಕ ಸಂಬಂಧವನ್ನು ಹೊಂದಿರುವ ಆ ಹೆಂಗಸನ್ನು ವ್ಯಭಿಚಾರಕ್ಕೆ ಕೇವಲ ಸಹಾಯ ಮಾಡಿದವಳು ಎಂದು ಪರಿಗಣಿಸಲಾಗುವುದು ಮತ್ತು ಆಕೆಗೆ ಯಾವ ಶಿಕ್ಷೆಯೂ ಇರುವುದಿಲ್ಲ” ಅಂದರೆ ವ್ಯಭಿಚಾರದಲ್ಲಿ ಪಾಲ್ಗೊಂಡ ಗಂಡಿಗೆ ಶಿಕ್ಷೆ ಮತ್ತು ಹೆಣ್ಣಿಗೆ ವಿನಾಯಿತಿ! ಇಲ್ಲಿ ಹೆಣ್ಣಿಗೆ ಶಿಕ್ಷೆ ಯಾಕಿಲ್ಲ ಎಂದರೆ ಮದುವೆಯಾದ ಹೆಣ್ಣು ತನ್ನ ಗಂಡನ ಸೊತ್ತು. ಅದು ಹೇಗೆ ಅಂದ್ರೆ ಉದಾಹರಣೆಗೆ ಒಬ್ಬ ಗಂಡಸಿಗೆ ಸೇರಿದ ಒಂದು ವಸ್ತುವನ್ನು ಇನ್ನೊಬ್ಬ ಗಂಡು ಅನುಮತಿಯಿಲ್ಲದೆ ಉಪಯೋಗಿಸುತ್ತಾನೆ. ಆಗ ಆ ಇನ್ನೊಬ್ಬ ಗಂಡಿಗೆ ಶಿಕ್ಷೆಯಾಗಬೇಕು ಸರಿ ತಾನೇ? ಆ ವಸ್ತುವನ್ನು ಉಪಯೋಗಿಸಲು ಅದರ ಮಾಲೀಕನ ಒಪ್ಪಿಗೆ ಬೇಕೇ ಬೇಕು... ಅಲ್ವೇ? ಹಾಗೆಯೇ ಇಲ್ಲಿಯೂ ಒಬ್ಬನ ಪತ್ನಿ ಅವನ ಅನುಮತಿ ಇಲ್ಲದೆ ಇನ್ನೊಬ್ಬ ಗಂಡಿನ ಜೊತೆ ಲೈಂಗಿಕ ಸಂಬಂಧ ಹೊಂದಿದರೆ ಆ ಗಂಡಿಗೆ Section 497 ಶಿಕ್ಷೆ ವಿಧಿಸುತ್ತದೆ. ಆದರೆ ಆ ಹೆಂಗಸಿಗೆ ಯಾವ ಶಿಕ್ಷೆಯೂ ಇಲ್ಲ !! ಆದರೆ ಈ ಸಂಬಂಧಕ್ಕೆ ಗಂಡನ ಒಪ್ಪಿಗೆ ಇದ್ದರೆ ಅದು ವ್ಯಭಿಚಾರ ಅಲ್ಲ. ಆದ್ದರಿಂದ ಗಂಡನ ಒಪ್ಪಿಗೆ ಅತಿ ಮುಖ್ಯ ಅಂತಾಯ್ತು!! ಜೊತೆಗೆ ಯಾವುದೇ ಗಂಡಸು ಅವಿವಾಹಿತ ಹಾಗು ವಿಧವೆಯ ಜೊತೆ ಲೈಂಗಿಕ ಸಂಬಂಧ ಹೊಂದಲು ಅವಕಾಶ ಮಾಡಿ ಕೊಡುತ್ತದೆ. ಯಾಕೆ ಹೇಳಿ... ಈ ಮಹಿಳೆಯರಿಗೆ ಒಡೆಯ ಎನಿಸಿಕೊಳ್ಳುವವರು ಇರುವುದಿಲ್ಲ. ಇಂಥ ವಿರೋಧಾಭಾಸಗಳಿದ್ದುದರಿಂದ ಈ ಕಾಯ್ದೆಯನ್ನು ಸುಪ್ರೀಂ ಕೋರ್ಟ್ ನಿಷೇಧಿಸಿತು. ಯಾಕೆಂದರೆ ನಮಗೆ ಗಂಡು ಹೆಣ್ಣನ್ನು ಸಮಾನವಾಗಿ ಕಾಯುವ-ಶಿಕ್ಷಿಸುವ ಅಥವಾ ಕ್ಷಮಿಸುವ ಕಾನೂನು ಮಾತ್ರ ಬೇಕು ಅಲ್ಲವೇ? ಹಾಗಂತ ನಮ್ಮ ಮಾಧ್ಯಮಗಳು ವರದಿ ಮಾಡಿದಂತೆ ಇನ್ನು ಹೆಂಗಸರೂ ಆರಾಮವಾಗಿ ಯಾರ ಜೊತೆ ಬೇಕಾದರೂ ಲೈಂಗಿಕ ಸಂಬಂಧ ಹೊಂದಬಹುದೇ? ಖಂಡಿತ ಇಲ್ಲ... ಆ ವಿಚಾರಗಳಿಗೆ ಬೇರೆ ಕಾನೂನುಗಳಿವೆ.. ಶಿಕ್ಷೆಯೂ ಇದೆ. ಕೇವಲ Section 497 ಇರುವುದಿಲ್ಲ ಅಷ್ಟೇ... ರೋಚಕ ಸುದ್ದಿಗಳನ್ನು ಬೇಜವಾಬ್ದಾರಿಯಿಂದ ಪ್ರಕಟಿಸುವ ಮಾಧ್ಯಮಗಳ ಬಾಯಿ ಮುಚ್ಚಿಸುವ, ರೋಚಕ ಸುದ್ದಿಗಳನ್ನು ಕಣ್ಣು ಮುಚ್ಚಿ ನಂಬುವ ಜನರ ಕಣ್ ತೆರೆಸುವ ಕಾನೂನು ಎಂದು ಬರುವುದೋ?
